An occupant of a TTC bus was injured because the vehicle struck a raised manhole cover in a construction zone. Statutory Accident Benefits are not payable to an occupant of a public vehicle if the vehicle did not collide with another vehicle or “any other object” (ss. 268 1.1 of Insurance Act). Licence Appeal Tribunal (LAT) finds that a raised manhole cover is “any other object” and therefore the claimant is not precluded from claiming Accident Benefits. Great work by Sean Brown, J.-C.
